A trustee must:
- Be at least 18 years of age
- Not have a legal disability
- Have the capacity to own property
- Be aware of the role they are accepting and their responsibilities. The trustee must sign the trust deed when setting up the trust. This is usually a sign that they are aware of and accept the role.
A trustee can be either an individual or a company. If there is a corporate trustee it is the company's directors who administer the trust.
